BC Hospitality Group LLC and its affiliates (collectively, “we” or the “Company”) acknowledge and are committed to the protection of the privacy of our users and customers. This privacy policy (“Privacy Policy”) outlines the types of information that we may collect from you or be provided about you when you visit or use any website or mobile application owned or operated by us, including www.eatbychloe.com (collectively, the “Site”) and our practices for collecting, using, protecting, maintaining and sharing that information.

Please read this Privacy Policy carefully. Please note that this Privacy Policy may change from time to time, so please check back regularly to stay informed of any changes. Changes to this Privacy Policy will be posted on eatbychloe.com/privacy. If you do not agree with this Privacy Policy, you must immediately stop using the Site. Your continued use of the Site following such changes, constitutes and signifies your full acceptance of such changes.

This Privacy Policy applies to information that we collect on or through the Site. It does not apply to information that we may collect offline or that any third-party may collect about or from you, including through any website or other means that we may provide a link to or that is otherwise accessible on the Site or in any communication from us, unless that third-party shares your information with us. Information We May Collect

Personal Information You Provide to Us

You may provide us with personal information as you use and fill out forms on the Site. The type of personal information that you may provide to us about you includes: your name, your birthday and your email address. For example, when you sign up to receive our newsletter, you provide us with your email address.

Information Provided to Us by Our Partners

You may access a website or use a mobile application that is owned, operated or “powered by” any of our third-party partners (collectively, our “Partners”). For example, the by CHLOE. mobile app is powered by Level Up and the by CHLOE. WiFi login is operated by SplashAccess. These Partners may collect information from or about you. Our Partners’ collection of your information is not covered by this Privacy Policy, so we recommend that you read their privacy policies carefully. Our Partners may also share information that they receive or collect about you with us, and we may add this information to information that we have collected or received from you. In addition to any aggregated or analytic data, types of personal information that may be shared with us by our Partners include:

  • Your name;
  • Your birthdate;
  • Your address;
  • Your phone number; and
  • Your email address.

As an example, if you place an order through Brandibble, we will receive the details of your order along with your name, phone number, address and email address or if you log onto our WiFi in a by CHLOE. restaurant through SplashAccess, you provide your name, email address and birthdate, and that information is shared with us in order to send you offers (if you consented to receive offers from us when you provided your information). Our use of this information will be subject to this Privacy Policy and our Partners’ use of this information (and any other information they may collect) will be subject to our Partners’ Privacy Policy.

We do not collect, store, process or receive credit card numbers from our Partners or otherwise. This type of information may be collected by our Partners and subject to their privacy policies.

Automatically Collected Data

In addition, when you visit or use the Site, we may automatically gather and store certain information about your usage. Automatically collected data may include:

  • Your IP address (i.e., the number that is automatically assigned to your computer whenever you are using the Internet) or device identifier (i.e., the number assigned to your tablet, mobile phone or other device you use to access the Internet);
  • The type of browser, device and operating system you have used to access the Site;
  • The date, time and location at which you access the Site; and
  • The content on the Site that you browse and browsing actions and patterns.

As described above, we may use automatic data collection technology to collect certain information about your equipment and browsing patterns. We use cookies on the Site that automatically collect information about you. “Cookies” are a small data file that are stored on your computer’s hard drive by your browser. We use these cookies to improve our website functionality and the overall experience of our customers. The information gathered and stored is utilized anonymously and does not contain anything that can identify users personally. Most browsers allow you to turn off the cookie function. If you turn off the cookie function, certain features of the Site may not work properly.

We also use Google Analytics on our Site to collect usage data, to analyze how users use the Site, and to provide advertisements to you on other websites. This information is anonymous and does not include personal information. Any automatically collected data is statistical, aggregated or anonymous data and does not include personal information.

The Site does not currently respond to “Do Not Track” signals from your browser or otherwise.

We generally use automatically collected data to improve the Site’s functionality and to understand how users interact with the Site. We may also use information that we collect about you (including personal information) in the following ways:

  • To provide you with by CHLOE.-related information, promotions, offers, products or services that you request from us or that you have consented to receive;
  • To fulfill any purpose for which you provide it;

  • In any other way we may describe when you provide the information; and

We do not sell your personal information to third-parties for their direct marketing purposes.

  • With our third-party service providers and other third parties whose services we use to support our business to the extent reasonably necessary for the provision of those services (including to help us manage our customer relations and marketing communications);
  • With our affiliates who operate the by CHLOE. business for the purpose of operating the business;
  • For any purpose disclosed by us when you provided the information to us;
  • With your consent;
  • To meet legal requirements and to comply with any court order, law or legal process, including to respond to any government or regulatory request or valid discovery requests or subpoenas;
  • To provide information to our representatives and advisors, including our attorneys and accountants, to help us comply with legal, accounting and security requirements;
  • To protect our rights, property, or safety or the rights, property, or personal safety of our visitors and the public; and/or
  • To enforce or apply our Terms of Use and other agreements or to prosecute and/or defend a court, arbitration or other similar legal proceeding.

Company Transactions

At any time, we may be involved in a sale, merger, consolidation, change in control, transfer of substantial assets, bankruptcy, reorganization, liquidation or other corporate transaction. In such a case, your information may be one of the business assets we transfer. You acknowledge that such transfers may occur and are permitted by this Privacy Policy, and that any entity that acquires us, is merged with us or that acquires our assets may continue to process your information as set forth in this Privacy Policy.

How We Protect Your Information

We take commercially reasonable steps to secure your personal information from accidental loss, theft, misuse, or disclosure. However, we cannot guarantee the security of any information.


The Site is not intended for children under the age of 18. We do not knowingly request or gather personal information from users who are under the age of 18. If personal information is gathered from a child under the age of 18 and we learn that the personal information is the information of a child under the age of 18, we will make the effort to delete the information. If you, as a parent or guardian of the child, believe that we might have personal information from a child under the age of 18 or the applicable minimum age in your jurisdiction, please contact us at privacy@eatbychloe.com, and we will delete the personal information from our records within a reasonable period of time. Please note that you may have to reach out to our Partners separately to delete the personal information from their records.

Links to Third Party Sites and Social Media

The Site may offer social sharing features and other integrated tools, such as the Facebook, Twitter and Pinterest buttons (e.g., “Like,” “Tweet” and “Pin It”), which let you share actions you take on the Site with other media. Your use of these features may enable the sharing of information outside of the Company and, potentially, with the public. If you click on a link to a third-party website or use a third-party service (including, without limitation, those listed above), you will leave the Site and go to the web site or service you selected. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your personal information by such third parties. IF YOU VISIT A THIRD-PARTY WEB SITE THAT IS LINKED TO ON THE SITE OR IN ANY OTHER COMPANY COMMUNICATION, YOU SHOULD CONSULT THAT WEBSITE’S PRIVACY POLICY BEFORE PROVIDING ANY PERSONAL OR OTHER INFORMATION. Consent to Transfer to the United States

Please note that you may also have to contact our Partners to have your information removed from their systems.

Accessing and Modifying Your Data

You may send us an email at privacy@eatbychloe.com to request access to, or to request that we correct or delete any of your personal information in our records. Please note that we cannot make any changes that we believe would violate any law or legal requirement or would otherwise be incorrect.

California Privacy Rights

Under California Civil Code Section 1798.83, California residents have the right to request in writing from certain businesses with whom they have an established business relationship a list of all third parties with whom the business has shared certain personal information (if any) during the immediately preceding calendar year for the third parties’ direct marketing purposes.
